Acceptable Use Policy for utxo AG Agentic Services

This Acceptable Use Policy ("AUP") governs the use of agentic services ("Agentic Services") provided by utxo AG, Dammstrasse 16, 6300 Zug, Switzerland ("utxo") via the Agentic Service Marketplace ("Marketplace") by the user ("User").

1. PROHIBITED USES
The User shall not use the Agentic Service for illegal or unauthorized purposes. In particular, the User shall not:

1. Defame, abuse, harass, stalk, threaten or otherwise violate the legal rights (including privacy rights) of others;
2. Process, publish, distribute, or disseminate obscene, pornographic, or otherwise unlawful materials, or harm minors;
3. Generate code or software intended to harm, including viruses, worms, trojans, or other malicious software;
4. Upload or use protected material (e.g., copyrighted, trademarked, patented) without proper rights or licenses;
5. Interfere with or disrupt the Agentic Service or its infrastructure;
6. Interfere with other Users' access to or use of the Agentic Service;
7. Promote or pursue unlawful purposes or activities;
8. Promote or distribute content harmful to minors or classified as such under applicable laws;
9. Generate, promote or disseminate disinformation;
10. Attempt to gain unauthorized access to the Agentic Service or related systems;
11. Circumvent contractual usage limits or misuse utxo's intellectual property;
12. Frame or mirror any part of the Agentic Service, except on internal intranets or as authorized by utxo;
13. Use the Agentic Service in violation of applicable Swiss or international law, especially those governing AI and export control.

2. PROHIBITED AI PRACTICES UNDER THE EU AI ACT (Regulation (EU) 2024/1689)
The User shall not use the Agentic Service for or in connection with any AI practices prohibited by the Artificial Intelligence Act, including:

1. Use of manipulative, deceptive, or subliminal techniques that impair autonomy and cause harm;
2. Exploitation of vulnerabilities due to age, disability, or socio-economic conditions;
3. Creation or extension of facial recognition databases without explicit consent;
4. Real-time remote biometric identification for law enforcement in public spaces;
5. Social scoring or behavioral profiling that results in discrimination or adverse outcomes;
6. Predictive criminal profiling based solely on personal traits;
7. Emotion recognition in workplaces or educational settings (except for safety or medical purposes);
8. Categorization of individuals using biometric data to infer sensitive characteristics (e.g., race, religion, political views).

3. HIGH-RISK AI SYSTEM RESTRICTION
The User may not transform or use the Agentic Service as a high-risk AI system within the meaning of the EU AI Act (Regulation (EU) 2024/1689).

4. REVERSE ENGINEERING AND UNAUTHORIZED MODIFICATION
The User shall not decompile, disassemble, or reverse-engineer the Agentic Service, or attempt to discover the source code or system architecture, unless explicitly allowed by applicable law. The User may not rent, lease, sell, sublicense, assign, distribute, mirror, or modify the Agentic Service or any of its components.

5. ENFORCEMENT
utxo reserves the right to investigate any suspected violation of this Acceptable Use Policy and to take appropriate action, including suspension or termination of access to the Agentic Service.
