1. PURPOSE AND SCOPE
This Acceptable Use Policy ("AUP") governs the use of utxo AG's Agentic Services. This AUP forms part of the Agentic Service Terms and applies to all users of our services. Violation of this AUP may result in suspension or termination of service access.
2. PROHIBITED USES
2.1 High-Risk and Regulated Domains
Users shall NOT deploy Agentic Services for:
- Medical or Healthcare: Diagnosis, treatment recommendations, medical advice, or healthcare decision-making
- Emergency Services: Critical emergency response, disaster management, or life-safety applications
- Legal Services: Legal advice for critical decisions, contract interpretation, or legal representation
- Financial Services: Investment advice, credit decisions, insurance underwriting, or financial planning
- Biometric Systems: Identity verification, facial recognition, or biometric categorization
- Critical Infrastructure: Control of power grids, transportation systems, or other critical infrastructure
- Child Safety: Any application involving minors without appropriate safeguards and parental consent
- Law Enforcement: Predictive policing, criminal risk assessment, or judicial decision support
2.2 Illegal Activities
Users shall NOT use Agentic Services to:
- Generate, distribute, or facilitate illegal content or activities
- Violate applicable laws, regulations, or third-party rights
- Engage in fraud, scams, or deceptive practices
- Circumvent sanctions, export controls, or embargo restrictions
- Launder money or finance terrorism
2.3 Harmful Content
Users shall NOT generate or distribute:
- Content promoting violence, terrorism, or extremism
- Hate speech targeting individuals or groups based on protected characteristics
- Child sexual abuse material or content sexualizing minors
- Non-consensual intimate imagery or deepfake pornography
- Content designed to harass, threaten, or intimidate individuals
- Misinformation intended to cause public harm
2.4 Intellectual Property Violations
Users shall NOT:
- Generate content that infringes copyrights, trademarks, or other IP rights
- Attempt to recreate proprietary works without authorization
- Use outputs to compete directly with original creators' works
- Violate third-party licensing terms or usage restrictions
2.5 Privacy and Data Protection Violations
Users shall NOT:
- Process personal data without lawful basis or consent
- Generate content using special category personal data without explicit DPA
- Create profiles or make decisions about individuals without transparency
- Violate GDPR, CCPA, or other applicable privacy laws
- Use data for purposes incompatible with original collection
2.6 System Abuse
Users shall NOT:
- Attempt to reverse engineer, hack, or compromise the services
- Use automated tools to exceed rate limits or quotas
- Share access credentials or circumvent authentication
- Interfere with service availability or performance
- Extract or scrape training data or model parameters
3. REQUIRED USER SAFEGUARDS
3.1 Human Oversight
Users MUST:
- Implement appropriate human review of all AI outputs before publication or reliance
- Maintain qualified human decision-makers for critical applications
- Establish clear escalation procedures for edge cases or uncertain outputs
- Document review processes and maintain audit trails where required
3.2 Accuracy and Validation
Users MUST:
- Independently validate AI outputs for accuracy and suitability
- Implement fact-checking procedures for factual claims
- Clearly label AI-generated content where legally required or industry standard
- Maintain liability insurance appropriate to their use case
3.3 Transparency and Disclosure
Users MUST:
- Disclose AI assistance to end users where legally required or ethically appropriate
- Provide clear information about system limitations and potential errors
- Maintain transparent processes for user complaints and corrections
- Comply with AI transparency requirements in applicable jurisdictions
4. COMPLIANCE OBLIGATIONS
4.1 Legal Compliance
Users are responsible for:
- Compliance with all applicable laws and regulations in their jurisdiction
- Obtaining necessary licenses, permits, or approvals for their use case
- Meeting industry-specific regulatory requirements
- Maintaining appropriate records and documentation
4.2 Third-Party Terms
Users must:
- Review and comply with terms of any third-party AI providers integrated into services
- Respect usage restrictions and licensing terms of upstream models
- Ensure compatibility between third-party terms and intended use
4.3 Export Controls and Sanctions
Users must not:
- Provide services to individuals or entities on restricted party lists
- Export or re-export services to embargoed countries or regions
- Use services in violation of U.S., EU, UK, or Swiss export control laws
5. REPORTING AND ENFORCEMENT
5.1 Violation Reporting
To report AUP violations:
- Email: support@nmkr.io
- Marketplace: Use the built-in reporting mechanism
- Emergency: For immediate safety concerns, contact local authorities first
5.2 Investigation Process
Upon receiving reports, utxo will:
- Acknowledge receipt within 48 hours
- Investigate reported violations
- Take appropriate action based on severity and impact
- Notify relevant parties of resolution
5.3 Enforcement Actions
Violations may result in:
- Warning: Written notice and opportunity to cure
- Suspension: Temporary restriction of service access
- Termination: Permanent account closure and service ban
- Legal Action: Referral to law enforcement or civil proceedings where appropriate
5.4 Appeals Process
Users may appeal enforcement actions by:
- Submitting written appeal within 30 days
- Providing evidence of compliance or corrective measures
- Participating in good faith discussion to resolve issues
6. UPDATES AND MODIFICATIONS
- This AUP may be updated from time to time to reflect legal changes, new risks, or service evolution
- Material changes will be communicated via the Marketplace with 30 days advance notice
- Continued use after the effective date constitutes acceptance of updates
- Users are responsible for regularly reviewing the current version
